End User License Agreement
This agreement is between you and Midnight Kitty LLC, d/b/a Midnight Kitty Games ("we"). By installing or playing Fatespun you agree to it. It works together with the Terms of Service and the Privacy Policy.
License grant
We grant you a personal, limited, non-exclusive, non-transferable, revocable license to install and play Fatespun for your own entertainment on devices you control, through Steam or the App Store.
Ownership
Fatespun, including its code, art, music, text and names, belongs to Midnight Kitty LLC and its licensors. You receive a license, not ownership.
Restrictions
You may not:
- reverse engineer, decompile or disassemble the game, except where the law allows it despite this clause;
- modify the game client or its saved data to forge progress, unlocks, rewards or purchases;
- cheat, or use tools that give you an unfair advantage or interfere with the servers;
- sell, trade or share accounts or virtual items, or copy and redistribute the game.
Virtual items and the store
Virtual items and the in-game store are a limited license to use content inside the game. They have no cash value and may be changed or retired. Steam purchases are governed by Steam's terms and refund policy; App Store purchases by Apple's.
Accounts and server rules
Accounts are required for cloud saves and progression. Progress is verified and signed on our server, and data that fails verification, including forged or tampered data, is discarded. We may reset or remove progress obtained by cheating.
Termination
This license ends if you break it. We may suspend or close your account for breach. You may end it at any time by deleting your account in the game and uninstalling. Sections that by nature should survive, such as ownership and liability, survive.
Updates and Early Access
We may update the game at any time. While Fatespun is in Early Access it will change: content and balance may be added, reworked or removed, and progress may be adjusted.
No warranty
The game is provided "as is" and "as available," without warranties of any kind, express or implied.
Limitation of liability
To the fullest extent the law allows, Midnight Kitty LLC, d/b/a Midnight Kitty Games is not liable for indirect, incidental or consequential damages, or lost data or profits. Our total liability is limited to what you paid us in the 12 months before the claim, or $50 if you paid nothing.
Governing law
This agreement is governed by the laws of the State of California, United States, without regard to conflict of law rules.
