Terms of Service
These terms apply to your use of Fatespun and fatespun.com. By playing or creating an account you agree to them. The End User License Agreement is part of these terms.
License to play
We give you a personal, non-exclusive, non-transferable license to play Fatespun on your own devices. We keep all rights in the game, its art, music and code. The EULA sets out the license and its limits.
Accounts and conduct
- You are responsible for your account and for keeping your sign-in secure. One person per account.
- Choose a handle that is not hateful, impersonating or unlawful. We may change or remove one that is.
- Do not cheat, forge progress or purchases, tamper with the game or its servers, or sell or trade accounts.
- We may suspend or close accounts that break these terms.
Virtual items
Cosmetics and other virtual items in the in-game store are a limited license to use them in the game. They are not property, have no cash value, and cannot be transferred or resold. We may change, rebalance or retire items and features, and the game is still in development.
Purchases and refunds
Purchases made through Steam follow Steam's terms and Steam's refund policy, and refunds are handled by Steam. Purchases through the App Store follow Apple's terms.
Your data
How we handle your data is described in the Privacy Policy. You can delete your account from the game's account screen at any time.
No warranty
The game is provided "as is" and "as available," without warranties of any kind, express or implied, including fitness for a particular purpose. It is under active development and may contain bugs, change, or be interrupted. Saves are backed up in the cloud, but we cannot promise they will never be lost.
Limitation of liability
To the fullest extent the law allows, Midnight Kitty LLC, d/b/a Midnight Kitty Games is not liable for indirect, incidental, special or consequential damages, or for lost data, profits or goodwill. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim, or $50 if you paid nothing. Some places do not allow these limits, so they may not apply to you.
Governing law
These terms are governed by the laws of the State of California, United States, without regard to conflict of law rules.
Changes and contact
We may update these terms and will change the date above when we do. Continuing to play after a change means you accept it. Questions: support@fatespun.com.
